Laws Requiring Service on the Attorney General Section 3

Health & Safety Code § 19954.5 - Mandatory service on State Solicitor General of each party's brief or petition and brief in causes of action based on violation of specific civil rights statutes. Service on the Solicitor General under this statute is required in any proceeding in the Supreme Court of California, a state court of appeal, or the appellate division of a superior court (actions regarding disabled access to places of public amusement and resort - accessible seating and accommodations).

Health & Safety Code § 19959.5 - Requires service on State Solicitor General of each party's brief or petition and brief in causes of action based on violation of specific civil rights statutes. Service on the Solicitor General under this statute is required in any proceeding in the Supreme Court of California, a state court of appeal, or the appellate division of a superior court (actions regarding disabled access to privately funded public accommodations).

Health & Safety Code § 25249.7(d)(e)(f) - Requires service on the AG of any actions filed in the public interest to enforce the Safe Drinking Water and Toxic Enforcement Act of 1983 (Proposition 65) and their outcome.

Insurance Code § 10139(a) - Until January 1, 2022, requires applications for the transfer of structured settlement and certain related documents to be filed with the Attorney General's Office. After that date these documents must be retained by the transferee, rather than being sent to the Attorney General's Office. See AB 1578 of 2021.

Probate Code § 1209(a) - Where notice is required to be given to the State of California, the notice shall be given to the Attorney General at the office in Sacramento.

Probate Code § 8903 - Requires notice to AG of hearing of application of waiver of appraisal by probate referee if portion of estate is to escheat to the State. Service of notice shall be effected on the Attorney General in Sacramento.

Probate Code § 8111 - Requires notice to AG of hearing of a petition for administration of a decedent's estate if the will involves or may involve a testamentary charitable trust without a designated trustee resident in this state, or a devise for charitable purposes without an identified devisee.

Probate Code § 10581 - Requires notice to AG of proposed action in probate matter if portion of estate is to escheat to the State. Service of notice shall be effected on the Attorney General in Sacramento.

Probate Code § 11601(d) - Requires notice to AG of hearing of a petition for distribution of an estate, "if any portion of the estate is to escheat to the state and its interest in the estate would be affected by the petition".

Probate Code § 16061.7(b) - Requires notification by trustee of change of trustee of irrevocable trust occasioned by death of settlor of a charitable trust.

Probate Code § 17203(a) - Requires notice to AG of proposed action in probate matter concerning internal affairs of a charitable trust, or to determine the existence of a charitable trust.

Probate Code § 17203(a)(3) - Requires notice to AG of hearing of a petition concerning the internal affairs of the trust or to determine the existence of the trust if the petition relates to a charitable trust subject to the jurisdiction of the Attorney General.

Probate Code § 18507(b) - Requires notice to AG in probate matters involving an action to release donor-restricted gift under the Uniform Management of Institutional Funds Act.

Public Resources Code § 21167.7 - Requires any party filing a petition pursuant to Public Resources Code section 21167 of the California Environmental Quality Act (CEQA) to furnish a copy of the petition, as well as any amended or supplemental petition, to the Attorney General’s Office within 10 days after filing the pleading.

Public Resources Code § 6462 - Requires service of summons on the Attorney General in an action by person claiming any interest in or to real property which is alleged to be claimed by the state to be situated in the former bed of a navigable river or stream in the state.

Public Resources Code § 7555 - Requires service of summons on the Attorney General in suits by persons in any case to establish boundaries of and to quiet title to land or any portion thereof where the state has sold lands acquired by it as swamp and overflowed lands.
