
California Assembly Bill 2319 (AB 2319) (Wilson), signed into law on September 26, 2024, aims to reduce the alarming and disproportionate maternal mortality rate of Black women and other pregnant persons of color by ensuring the successful implementation of Senate Bill 464 (SB 464) (Mitchell), the California Dignity in Pregnancy and Childbirth Act. These laws mandate that health care facilities implement “an evidence-based implicit bias program . . . for all health care providers involved in perinatal care.” (Health & Saf. Code, § 123630.3.) The implicit bias program must, among other things, include “[r]ecognition of intersecting identities and the potential associated biases,” “[i]nformation on reproductive justice,” “[d]iscussion of power dynamics,” and “[i]dentification of personal, interpersonal, institutional, structural, and cultural barriers.” (Health & Saf. Code, § 123630.3, subds. (b)(11), (b)(10), (b)(7), (b)(2).)
Current health care providers must have completed training by June 1, 2025, and any new providers must complete it within six (6) months of starting, with refresher courses required at least every two years. (Health & Saf. Code, § 123630.3, subd. (c).) Health care facilities must track completion status and report compliance to the Attorney General. (Health & Saf. Code, § 123630.3, subds. (f)–(g).)
Beginning February 1, 2026, each covered facility shall “provide the Attorney General with proof of compliance.” (Health & Saf. Code, § 123630.3, subd. (f).) For purposes of implementation, all covered facilities will complete and submit the annual compliance report using a secure online survey, which the Attorney General’s Office will provide to designated facility points of contact.
Additional information, including step-by-step reporting instructions and access details for the survey, will be provided closer to the reporting period.
To ensure accurate distribution of the reporting survey, each facility must designate a primary point of contact responsible for compliance reporting. The Attorney General’s Office has created an online form for facilities to submit their designated contact person, including name, title, e-mail address, and phone number. Facilities are encouraged to complete this form by November 1, 2025, to help ensure timely distribution of survey materials. Hospital systems may designate a single point of contact for all facilities within the system; however, they must submit separate compliance information for each facility and aggregate data will not be accepted.
