Protecting Our Kids from Social Media Addiction Act (SB 976)

Summary

Signed into law in September 2024, Senate Bill 976 the “Protecting Our Kids from Social Media Addiction Act” (the “Act”) makes it unlawful for online platforms, including social media, to provide addictive feeds and certain features to minors without first obtaining verifiable parental consent. The Act requires the Attorney General to adopt regulations regarding age assurance and parental consent methods in furtherance of the Act’s purpose by January 1, 2027. As part of this rulemaking process, the Attorney General invites all members of the public to provide comments.

Status of the Proposal: The Department will hold a public hearing to provide all interested persons an opportunity to present statements or arguments, either orally or in writing, with respect to the proposed regulations, as follows:

The Department requests, but does not require, that persons who provide oral comments at the hearing also submit a written copy of their testimony to SB976@doj.ca.gov.

This rulemaking is undergoing a 45-day public comment period. Any person or their authorized representative may submit written comments regarding the proposed regulatory action. The written comment period closes at 5:00 pm on June 30, 2026. All timely comments that specifically pertain to the proposed regulations will be reviewed and responded to by Department staff.
